Assumption of Risk: By the very nature of the activity, golf and the related physical conditioning activities carry a risk of physical injury. No matter how careful the student and the teacher are, the risk cannot be eliminated. The risk of injury includes minor injuries such as bruises and more serious injuries such as broken bones, dislocations and muscle pulls. Sports or any activity that involves motion and rotation in a unique environment carries with it a reasonable assumption of risk. UGA is bound by law to inform all participants and/or their guardians of the risk involved in the activity of golf and related physical conditioning in general. In consideration for UGA accepting the applicant, and in consideration of the applicant having an opportunity to improve skills through the use of UGA staff, those legally responsible for the named enrolling student realize the risk of injury involved and hereby agree to assume the responsibility of such for said student and further agree to save and hold harmless Kate Tempesta’s Urban Golf Academy L.L.C. (UGA), its staff and teachers, and all others concerned, and to indemnify them against loss, intending to be legally bound.

Further, I give my permission for UGA to transport my child via a hired vehicle or their personal vehicle to a local area golf course or facility as outlined in the registration document affiliated with this Assumption of Risk policy.

Medical Release: I certify that the enrollee has no condition that prohibits full participation in the activities at UGA. I assume all ordinary risks when the enrollee is using the facilities and hereby release UGA, or any of its staff or teachers, for any injury or damage suffered in connection with said use of the facility. In case of emergency, if I cannot be reached, I authorize UGA, its agents and staff, to contact and secure necessary medical attention for the applicant.

Photo Release: UGA may, in the course of teaching classes and putting on performances, take photographs and/or video that include our enrolled students. If you DO NOT want your child to be included in UGA advertising / promotional materials / website, etc., please send us an email and we will mark it in your family account.

Electronic transmission of agreement to this Assumption of Risk and associated releases constitute my signature and acceptance in accordance with the registration form submitted.

MAKE-UP POLICY:
FOR NYC Fall & Spring Programs:

We offer one free make up per season, which must be approved and scheduled through the Urban Golf Academy office. For the Spring 2018 season, 9 classes are being offered for the price of 8. Therefore, students can have a free makeup after missing 2 classes.
Make-ups are not allowed in sold-out classes or in the first or last class of the semester.
Additional make ups can be scheduled for a $35 fee per class.
Any scheduled make-ups that are not cancelled 24-hour ahead of time will be considered a used make-up session.
Make-ups cannot carry over to future seasons.
We make every effort to determine the status of class no later than two hours before the scheduled start time of class, based on available hourly forecasts.
When we cancel a class, we place an announcement on our home page - www.ktuga.com - in the red box. And we send emails to the address provided on the registration form.
In most cases, drizzle or light rain does not constitute cause for cancellation.
Occasionally we will cancel classes due to adverse weather conditions with short notice or while class is in progress, if the safety of the children is in question.
If classes are cancelled by Urban Golf Academy, either a make-up class will be scheduled or credit toward a future season will be applied.
If parents or caregivers elect not to attend due to conditions, no make-up or refund will be offered.

For NYC Winter Programs:

A sibling discount IS AVAILABLE for select programs. Contact Kate Tempesta at ktuga.com for more specific details.
Makeups are not allowed for Winter Programs.
Pricing for Winter Programs is based on students attending 85% of the program dates.
In most cases, light to moderate snow does not constitute cause for cancellation. We make every effort to determine the status of class no later than two hours before the scheduled start time of class, based on available hourly forecasts.
When we cancel a class, we place an announcement on our home page -www.ktuga.com - in the red box. And we send emails to the address provided on the registration form.
Should your child not like the class after attending two sessions, your payment will be refunded less a $25.00 processing fee.

For NYC Summer Programs:

Summer classes are held rain or shine. An indoor location alternative will be provided.
A sibling discount IS AVAILABLE for select programs. Contact Kate Tempesta at ktuga.com for more specific details.
Makeups are not allowed for Summer Programs due to the week to week nature of the sign up.
We make every effort to determine the status of class no later than two hours before the scheduled start time of class, based on available hourly forecasts.
When we move a class, we place an announcement on our home page -www.ktuga.com - in the red box. And we send emails to the address provided on the registration form.
In most cases, drizzle or light rain does not constitute cause for cancellation.

We do not offer refunds for custom classes, and consider programs finalized upon receipt of payment of all participants

Golf, Tennis & Swim Camp and Golf & Swim Camp run rain or shine.
Evening Eagles Program run so long as the golf course is not closed.

Refunds/Makeups are provided for classes canceled by UGA only.
If parents or caregivers elect not to attend due to conditions, no make-up or refund will be offered.
If you must cancel your reservation, your cancellation fee will be determined according to the following formula:
– Full refund less $50 fee: 29+ days before start of session week
– 75% refund: 22 – 28 days before start of session week
– 50% refund: 15 – 21 days before start of session week
– 25% refund: 8 – 14 days before start of session week
– No refunds: 0 – 7 days
Exceptions to this policy cannot be made for any reason, including but not limited to weather and personal emergencies.
There is no refund for arriving late or leaving early.
