Liability Release:

The Parent/Legal Guardian named above certifies they have authority with the respect to custody and care of the participant and understands Spirit Athletics is relying on this certification. The Participant and/or the Parent/Legal Guardian gives permission for the participant to participate in any of the following applicable Spirit Athletics activities: recreational classes, All Star teams and special abilities programs. The Participant and/or the Parent/Legal Guardian listed above releases Spirit Athletics including owners, directors, employees, volunteers, sub-contractors, vendors, from any and all liability from any claim, demand, action or cause of action of any kind arising from any illness, injury or death of the participant as a result directly or indirectly participating in an activity listed above with Spirit Athletics. This indemnity extends to and includes all costs, legal or otherwise, incurred in defending such claims, demand, action or cause of action.

Medical Release:

The Participant and/or the Parent/Legal Guardian herby certify that the Participant does not suffer from any physical, mental, or medical condition that would pose a risk to the Participant while attending or participating in any Spirit Athletics activities including: competitive team training sessions, competitions, competitive team travel, exhibitions, community events, recreational classes, drop in programs/clinics, camps and/or camp activities, rentals and birthday parties. By submitting and signing this form or registering for any Spirit Athletics program, the Participant and/or the Parent/Legal Guardian acknowledge that participation in cheerleading and activities with Spirit Athletics involves certain inherent risks and regardless of the precautions taken, the participant may sustain injuries (minor, serious, catastrophic or fatal). The Parent/Legal Guardian, on his or her own behalf and on behalf of the Participant, or the Participant if they are the age of majority, herby assume all responsibility for any such risk and releases Spirit Athletics from any claims, demand, action or cause of action of any kind with respect to such injury. The Parent/Legal Guardian and the Participant authorizes Spirit Athletics to provide first aid treatment in event of an injury. If no medical treatment is provided, or if the provided treatment is ineffective, Spirit Athletics will not be liable in any way. The Parent/Legal Guardian and/or the Participant shall be responsible for all costs of any such treatment and indemnifies and holds harmless, Spirit Athletics or representatives in this regard.

Use of Image:

The Parent/Legal Guardian and the Participant acknowledges that Spirit Athletics and affiliates from time to time produce video, website content, social media posting, photographs, printed material and voice recordings for promotional or commercial use. The Parent/Legal Guardian, on his or her own behalf, and on the behalf of the Participant, or the Participant if they are the age of majority, acknowledge that the Participant may be included in such recordings as a participant or spectator with Spirit Athletics and consents to the same. The Parent/Legal Guardian and the Participant hereby transfer and assigns to Spirit Athletics, the exclusive right to make such recordings and utilize the Participant's image and/or voice for current or future promotional or commercial use.

Release of Participant:

Participants under the age of 18 are required to be physically picked up/signed out by a Parent/Guardian after each and every class and/or team practice and event, unless specified in writing. This process is to ensure the safety of the Participant. During registration, an option to allow the release of the Participant to specified parties will be given. Additionally, the option to allow the Participant to "sign themselves out" (leave the premesis) at the end of each and every class and/or team practice event will be given. These permissions can be changed at anytime as long as written permission (email preferred) is given.

Custody Arrangements:

If a Parent/Guardian requests that a Participant under the age of 18 NOT be released into the custody of another Parent/Guardian, a custody agreement must be provided. Spirit Athletics cannot deny a legal guardian access to pick up their child without legal proof. It is imperative that any custody agreements like this are disclosed to Spirit Athletics upon registration.

Refund Policy – All Star Members:

Within 10 days of a member’s first scheduled session (practice), they are entitled to a 100% refund, less any fees paid for by Spirit Athletics on behalf of the member within the 10 days, including by not limited to uniforms, apparel, competition fees, etc.

If a member withdraws from an All Star team, the tuition (including, but not limited to coaching and building fees) portion only from that date forward will be refunded by the close of the All Star season (May 31 of each year). All other fees are allocated to competition fees, suppliers, clothing etc. and cannot be refunded. The member will also be subject to a $200 cancellation fee, which will cover the cost of restructuring and reformatting any routine choreography or skills.

In the event of a cancellation by a member paying in installments, the tuition portion (including, but not limited to coaching and building fees) only from that date forward will no longer be charged. Any fees paid for by Spirit Athletics on behalf of the member that are outstanding remain the responsibility of the member no matter when the cancellation occurs.

Please submit withdrawal in writing to Info@SpiritAthletics.ca. A refund will be issued within 15 days and the account will no longer be charged.

Refund Policy - 10-Week Class Trial:

Refund Policy - 1-Month, 6-Month and 12-Month Class Members:

Within 10 days of a member’s first scheduled class, they are entitled to a 100% refund. No refunds will be issued after this. The remainder of a commitment must be paid out in order to end the contract.

Class Make-up Policy:

Class members will be permitted to schedule a make-up during the membership if space permits and must be pre-arranged. Please contact Spirit Athletics to confirm space for a make-up session and schedule. Single absences will not be added to the end of a membership. Competitive team practices do not receive make-ups.

Class Cancellation Policy:

Classes may or may not be cancelled due to holidays, scheduled gym closures, inclement weather and other reasons. Spirit Athletics may or may not schedule a make-up or opt to add the session to the end of the membership. Please contact Spirit Athletics to arrange during the membership.

NSF and Late Fees:

All monthly fees that are NSF (non-sufficient funds) will incur a $25+hst late penalty. Additionally, monthly fees that are not paid within 14 days of the arranged payment date will incur a $25+hst late penalty. After 15 days, athletes with outstanding account balances will not be able to participate and be required to sit at their class or team.

Bullying and Harrassment Policy:

Spirit Athletics is committed to providing a sport environment in which all individuals are treated with respect and dignity. Each individual has the right to participate in an environment which promotes equal opportunities and prohibits discriminatory practices.

Harassment is a form of discrimination and is prohibited by the Canadian Charter of Rights and Freedoms and by Human Rights legislation in every province and territory of Canada. Harassment/discrimination is offensive, degrading and threatening. In its most extreme forms, harassment can be an offence under Canada's Criminal Code.

Bullying is deliberately hurting a specific person either physically, verbally, psychologically or socially. It involves a power imbalance where one person has power or strength (e.g. physical, mental, social or financial) over another. It can be carried out by one person or several people who are either actively or passively involved. In a sports context bullying can take many forms, for example (but not limited to):

a parent telling their child that they are incompetent, hopeless, useless, etc.;
a coach alienating an athlete (adult or child);
several people ganging-up on an individual team member;
spectators verbally abusing athletes from the opposition;
an athlete calling a referee names and using put-downs;
a parent intimidating a young coach.

Bullying can be a 'one-off' incident, but usually involves repeated actions or incidences. It can occur everywhere: at home, school, work, playgrounds, while participating in sport, when using public transport or walking to or from home. An individual may bully their victim face to face or use technology such as a mobile phone or computer.

Members found to be bullying or harrasing anyone in any way will be removed from the program with no entitlement of a refund, will still be required to pay any fees that have been paid for by Spirit Athletics on behalf of the member, and will be billed a $500 bullying/harrassment fee.

Attendance Policy - Class Members

While classes are not mandatory, if a member is absent from a class for more than 2 instances in a row without notice, the member will be removed from that class and have to "re-enroll" through the Amilia system. If the member is removed from the class and the spot is filled, the member will not be able to attempt "re-enroll" until the following registration period. This policy is enforce is to ensure that the space is being utilized and not going to waste.

Attendance Policy - All Star Members

Attendance at all All Star practices and events is mandatory. Why? All Star Cheer is a TEAM sport. One athlete missing a practice greatly affects the team’s ability to master their skills and be ready for competition.

When is missing practice acceptable?

Contagious illness
Death in the family (including animals)
School functions REQUIRED for grades (note from a teacher is required)

Any appointments, vacations and other events should be planned around practice and event schedule. Any absence within 2 weeks of an event may result in removal of that athlete from the routine. This is to ensure that the team is in a position to perform well at the event.

Consistent and frequent absences throughout the season may result in removal of that athlete from the routine. The athlete will be placed back into the routine when the coaches feel that absences will no longer be an issue. A "return-to-play" action plan will be developed with the coach.

Perfect attendance for all practices and events will be noted at the end of the season and the athlete will receive a $50 credit on their account.

Use of Facility

The programming/classes are held in the gymnasium at St. Giles Presbyterian Church, 205 Linwell Rd, St. Catharines. My signature or online sign up for registration acknowledges the Church prohibits me or any person accompanying me from entering the Sanctuary located on the upper level of the Church.
