Policies, Terms, and Conditions for Participating in DBMS Activities

All participants who have registered themselves or a child dependent (“Participants” or a/the “Participant”) in a DBMS course, class, lesson, or activity (a “DBMS Program”) agree to the following policies, terms, and conditions:

1. Supervision of Youth Participants Under the Age of 18

DBMS is not responsible for supervising Participants under the age of 18 before or after class times. It is therefore important and necessary that parents/guardians of Participants under the age of 18 drop them off before classes and pick them up after classes ON TIME. DBMS will assign all Participants under the age of 18 an instructor who keeps daily attendance. Any questions regarding a Youth Participant’s progress should be directed to the instructor or Program Director.

2. Participant’s Required Swimming Ability

Many DBMS Program descriptions include a requirement that the Participant is a "Competent Swimmer." DBMS defines a Competent Swimmer as someone who is able to readily jump into deep water and then swim 25 yards unassisted. The Participant or the Participant’s parent/guardian agrees and attests that the Participant’s swimming ability meets or exceeds the definition of a Competent Swimmer. The Participant or the Participant’s parent/guardian further agrees that the Participant will properly wear a U.S. Coast Guard-approved life vest at all times while participating in DBMS on-the-water activities, except when rowing in a crew shell.

In addition to being a Competent Swimmer, all Participants taking a Jr. Competitive Rowing program must take and pass a formal swim test administered by and at the discretion of DBMS.

3. Weather Policy

All classes and courses will meet rain or shine, regardless of the weather. In the event of extreme weather, power outages, and unsafe travel, DBMS may cancel programs with no refund.

Private and Semi-Private lessons will meet depending on the weather conditions. Only DBMS staff may cancel or reschedule Private and Semi-Private lessons due to poor weather conditions. In some instances, this may be done with very short notice or even after the lesson has already started. After the decision to cancel is made, the Participant or the Participant’s parent/guardian will be notified as soon as possible and DBMS will attempt to reschedule the lesson if there is availability. For Private and Semi-Private lessons that DBMS is unable to reschedule, DBMS will issue a refund or credit.

4. Booking Cancellation / Refund Policy

As a nonprofit organization, DBMS depends on program revenue from full courses to maintain our high quality instruction. For this reason DBMS has a strict cancellation policy.

The following cancellation fees apply to ALL programs, courses, and lessons (youth & adult)

100% refund minus a $25 fee until 90 days before the beginning of the activity
50% credit minus a $25 fee until 60 days before the beginning of the activity
0% credit if canceled less than 60 days before the beginning of the activity
No refunds are given during a program if a participant is sick, fails to attend, is absent, or is dismissed due to unsafe behavior.
Any program with an installment payment plan is subject to the same cancellation policy and all payments are non refundable less than 60 days before the start of a program.
Rebooking credits must be redeemed within one year of their date of issuance.

If the Participant has a balance due, the refund amount is first applied to the balance due and the remaining amount is refunded. Any exceptions to this policy must be handled through the registrar by calling 781-934-7555.

5. Payment Policy

To secure a seat in a class and be placed on the roster, all classes must be paid IN FULL, or an installment plan arranged, at the time of registration. Class participation is not allowed unless the Participant is on the roster.

6. Waiver & Release of Claims

The Participant or the Participant’s parent/guardian agrees that the Participant will participate in all DBMS Programs for which the Participant has registered, and further consent to the Participant being a passenger in transportation to and from such DBMS Programs that is provided by DBMS, if needed. The Participant or the Participant’s parent/guardian fully recognizes and understands that there are dangers and risks inherent in all DBMS Programs, including but not limited to risk of illness due to Covid-19 exposure, and that accidents can occur on the water as well as on land during such DBMS Programs. Such illness and accidents can result in serious injury and even death. With full knowledge of these and all other dangers and risks attendant to DBMS Programs, and with informed consent, the Participant or the Participant’s parent/guardian, on behalf of themselves and their dependents, personal representatives, family, and heirs and assigns, knowingly and freely releases DBMS and all of its affiliates, governing boards, officers, directors, principals, trustees, legal representatives, members, employees, staff, volunteers, agents, administrators, assigns, and contractors (the “DBMS Releasees”) from any and all claims, demands, suits, judgements, damages, actions and liabilities of any kind, whenever occurring, whether known or unknown, at law or in equity, that the Participant or the Participant’s parent/guardian may suffer at any time arising from or in connection with the Participant’s attendance, participation, or involvement in such DBMS Programs, including but not limited to any injury or harm to the Participant or damage to the Participant’s property. Further, the Participant or the Participant’s parent/guardian agrees to indemnify and hold harmless the DBMS Releasees from any and all claims, demands, suits, judgements, damages, actions and liabilities of any kind, whenever occurring, whether known or unknown, at law or in equity, that the DBMS Releasees may suffer directly or indirectly arising from or in connection with any intentional or negligent acts or omissions of the Participant during the Participant’s attendance, participation, or involvement in such DBMS Programs.

7. Consent to be Photographed by DBMS

The Participant or the Participant’s parent/guardian agrees and consents that DBMS may photograph or record the Participant for publicity purposes, including: displaying images or video of the Participant on the DBMS website; or using images or video of the Participant in publications, media, and print collateral. The Participant or the Participant’s parent/guardian further gives DBMS specific, express permission to copyright, publish, distribute or display images or video of the Participant’s likeness for publicity purposes.

8. Statement of Medical Condition & Consent for Medical Treatment

The Participant or the Participant’s parent/guardian agrees and attests that the Participant is in good health and that there is no medical condition that precludes the Participant’s involvement in any of the DBMS Programs for which the Participant has registered.

Note: An examination by your physician is recommended before beginning any exercise program. Those currently under a physician's care should consult with their health care provider and obtain a release before participating in any DBMS Programs.

The Participant or the Participant’s parent/guardian agrees to notify DBMS staff of any pre-existing medical condition that may affect the Participant’s participation in DBMS Programs and will bring to DBMS any medications that the Participant may need while participating such as inhalers or epi-pens.

The Participant grants permission to DBMS and its employees to administer a medical treatment to the Participant that may be deemed necessary in event of an injury or illness.

9. Conduct Policy

The goal of DBMS programs is to develop participants' individual strengths, to improve their skills, and to have fun while doing so. DBMS Programs require a high standard of commitment, effort, and personal conduct. Decent, self-respecting behavior and true sportsmanship are expected of everyone (students as well as parents) while participating in DBMS Programs, while on DBMS property, and while representing DBMS off-campus. Failure to adhere to this code of conduct could result in disciplinary action, including suspension or expulsion without refund of program fees.

10. Scholarships

Financial Aid is limited to One Class per Season per Student and Limited to Participants under the age of 18. Anyone seeking information about financial assistance should visit the DBMS website, under Outreach for more information. Applications must be submitted at least two weeks prior to program start date.

11. Assumption of the Risk Relating to Coronavirus/COVID-19

DBMS cannot guarantee that the Participant will not become infected with COVID-19. Further, participating in DBMS programs could increase the Participant’s risk and the Participant’s family’s of contracting COVID-19.

In addition to the Participant’s waiver and release of claims in Section 6 above, the Participant or the Participant’s parent/guardian acknowledges and accepts: the contagious nature of COVID-19; the risk that the Participant and Participant’s family may be exposed to or infected by COVID-19 as a result of the Participant’s participation in DBMS Programs; and that such exposure or infection may result in personal injury, illness, permanent disability, and death. The Participant or the Participant’s parent/guardian further acknowledges and accepts that: the risk of becoming exposed to or infected by COVID-19 at DBMS may result from the actions, omissions, or negligence of the Participant and others, including, but not limited to, DBMS employees, volunteers, and other program participants and their families; and DBMS does not employ or contract with any medical service providers for ordinary or emergency medical services, including but not limited to COVID-19 screening or testing.

I have read and fully understand and agree to the above policies, terms, and conditions and fully understand and agree that I have given up substantial rights by agreeing to the terms and conditions on behalf of myself (and on behalf of my child/dependent, if I am registering for a DBMS Program on behalf of a child/dependent), and I do so voluntarily.

Participants under the age of 18 will not be able to start any DBMS Program until their parent/guardian agrees to the above policies, terms, and conditions.
