Middleton & District Swimming Pool Waiver and Release of Liability Form

I realize there is always potential danger or risk involved in swimming and aquatic instruction. I promise to strictly obey the rules and regulations of the Middleton & District Swimming Pool Facility, which are posted at the pool site. I also promise to obey the directions of the pool staff and lifeguards. I hereby release and forever discharge the Town of Middleton, the Middleton Swimming Pool Society, their respective servants, agents and employees from any claim or personal injury or loss of life caused by my failure to follow the rules and regulations of directions above referred to.

Acknowledgment and Assumption of Risk:

I understand and acknowledge that participation in programming at the Middleton & District Swimming Pool involves inherent risks and dangers, including but not limited to, the risk of personal injury, death, and property damage. I voluntarily choose to participate in these activities and assume all risks associated with such participation.

Release of Liability:

In consideration of being allowed to participate in the programs at the Middleton & District Swimming Pool, I hereby release, waive, discharge, and covenant not to sue the Middleton & District Swimming Pool, its officers, employees, agents, and volunteers (collectively referred to as "Releasees") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my child(ren), or to any property belonging to me, whether caused by the negligence of the Releasees or otherwise, while participating in the programs or while on the premises of the Middleton & District Swimming Pool.

Acknowledgment of Understanding:

I have read this Waiver and Release of Liability form, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by agreeing to this form I release all liability to the greatest extent allowed by law.
