I understand the responsibility I/my child is undertaking by becoming a Pegasus Cheer Athletics member. I agree to fully support my team/my child and will encourage them to fulfill their commitment. I understand that when representing the team, I must always conduct myself with class and responsibility. Furthermore, I understand that any athlete or parent that does not abide by the rules and regulations of Pegasus Cheer Athletics, that is consistently negative, or acts in a manner that jeopardizes the name and reputation of the gym or cheerleading program, will be subject to removal with no refund. In addition, I agree to give Pegasus Cheer Athletics full permission to seek medical attention and/or take any actions deemed necessary to ensure the safety and well-being of myself/my child and those around them. I also understand that any cheques returned for insufficient funds will be subject to a $25 NSF fee, which must be paid in full before continuing on in the program and that fees paid in advance are non-refundable.

I understand and agree to be: bound by all of Pegasus Cheer’s registration conditions; to familiarize myself with Pegasus Cheer’s activity safety guidelines; to inform Pegasus Cheer of medical conditions that might affect participation; that medical costs arising from participation at Pegasus Cheer are my responsibility; to permit the use of video and pictures of my activities for promotional purposes; and to HAVE A GREAT TIME AT PEGASUS CHEER.

1. The activities involved in this program are dangerous. I risk the chance of serious injury or death

2. My parents and I believe that I am physically, emotionally and mentally able to fully participate in this

program and as such have given their unqualified permission for me to take part.

3. I am familiar with, and will follow, all the applicable rules for participation in this program.

4. My equipment is mechanically fit and suitable for my use in this program.

5. I understand that at all times during my participation in this program, I have sole responsibility

for my safety.

6. If, during the course of my participation in this program:

(a) I learn or become aware of a change in my health, physical, emotional or mental

condition, or

(b) I feel unsafe or threatened for any reason, or

I WILL IMMEDIATELY STOP PARTICIPATING and INFORM THE NEAREST OFFICIAL.

7. I am willing to accept all risk of being hurt or killed in this program, both known and unknown, and

to take full responsibility for my actions and behaviour.

INDEMNITY AGREEMENT

IN CONSIDERATION of allowing my minor child/ward, ___________________________________________, to participate in the program, related events and activities of Pegasus Cheer Athletics.

I WARRANT TO YOU THAT:

1. I am a parent/guardian having full legal responsibility for decisions regarding my minor child/ward, and

2. I am familiar with the risk of serious injury and death which any participant in this program must assume, and

3. I believe that my minor child/ward is physically, emotionally and mentally able to participate in this program, and that

his/her equipment is mechanically fit for his/ her use in this program, and

4. I understand, and will instruct my minor child/ward, that all applicable rules for participation must be followed and that at all

times the sole responsibility for personal safety remains with my minor child/ward, and

5. I will immediately remove my minor child/ward from participation, and notify the nearest official, if at any time I sense or

observe any unusual hazard or unsafe condition or if I feel that my minor child/ward has experienced any deterioration in

his/her physical, emotional or mental fitness for continued participation in the program.

I UNDERSTAND AND AGREE, ON BEHALF OF MY MINOR CHILD/WARD, MYSELF, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES AND NEXT OF KIN, THAT MY EXECUTION OF THIS DOCUMENT CONSTITUTES:

1. an unqualified ASSUMPTION OF ALL RISKS associated with participation in this program by my minor child/ward even if

arising from negligence, or gross negligence, including any compounding or aggravation of injuries caused by negligent rescue

operations or procedures, of the program organizer and any persons associated therewith or participating therein, and

2. a FULL AND FINAL RELEASE AND WAIVER OF LIABILITY of the program organizer and all persons and organizations

associated with it and the program including, without limiting the generality of the foregoing, its officers, directors, officials,

agents and/or employees, other participants, sponsors, advertisers, owners and/ or lessors of the premises used to conduct

the program, sanctioning bodies, medical or rescue personnel (the RELEASEES), of and from with the respect to all injury,

disability, death or loss, or damage to person or property whether arising from the negligence, or negligent rescue of or by the

foregoing or otherwise, and

3. an UNDERSTANDING NOT TO SUE the RELEASEES for any loss, injury, costs, or damages of any form or type, howsoever

caused or arising, and whether directly or indirectly from the participation of my minor child/ward in the program, and

4. an AGREEMENT TO INDEMNIFY, and to SAVE and HOLD HARMLESS the RELEASEES, and each of them, from any

litigation expense, legal fees, liability, damage, award or cost, of any form or type whatsoever, they may incur due to any claim

made against them or any one of them whether the claim is based on the negligence or the gross negligence of the

RELEASEES or otherwise.

I UNDERSTAND THAT THE RELEASEES ARE RELYING UPON MY WARRANTIES, ASSUMPTIONS, WAIVER AND RELEASE, UNDERTAKINGS AND AGREEMENTS WHEN ACCEPTING MY MINOR CHILD'S/WARD'S PARTICIPATION IN THIS PROGRAM.

I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I GIVE UP SUBSTANTIAL LEGAL RIGHTS I AND/OR MY MINOR CHILD/WARD WOULD OTHERWISE HAVE.

I SIGN THIS DOCUMENT VOLUNTARILY AND WITHOUT INDUCEMENT.

Mandatory Attendance
Athletes are expected to attend practice each and every week, arriving 5 – 10 minutes early to ensure practice begins on time. Mandatory attendance includes regular weekly practice, extra practices, blackout periods, illness/injury, and competitions. I understand that should my athlete miss practice, their role may be affected and that their role on the team is up to the discretion of the coaches.

Injury or Illness
Should my athlete miss practice due to illness or injury, I understand that a medical form stating they are cleared to return to full team duties must be signed by a licensed practitioner and presented to Pegasus Cheer Athletics before my athlete is allowed to participate in practice and/or competitions. I understand that missing practice due to illness or injury may result in my athlete’s role in the routine being affected.

Athlete Safety
I understand that cheerleading is a dangerous sport, regardless of age, and I will keep the athletes’ safety as my top priority when allowed in the waiting area. Calling out to athletes or distracting them in any way is not safe and I understand that should I, or any other person with me, be distracting and jeopardize the safety of the athletes on the floor, we will be asked to leave the gym during practice.

Skills Retention
Athletes are expected to maintain, at the minimum, the skills they have demonstrated prior to the beginning of the season. I understand that should my athlete fail to maintain the skills they have previously shown, Pegasus Cheer Athletics reserves the right to alter their role on the team, including, but not limited to, placing them on a different team. I further understand that although Pegasus Cheer does its best to place athletes where staff believe is best suited for athlete potential, Pegasus Cheer reserves the right to place my athlete on a different team should staff determine that my athlete’s demonstrated skills are not in the best interest of the team or the athlete.

Videography/Photography
I understand that recording or photographing practices, athletes, and/or coaching staff is prohibited without the express permission of Pegasus Cheer Athletics.

Payment Schedule
Payments are non-refundable once paid, regardless of payment schedule chosen. I understand that should I choose one of the installment plans, failure to keep my payments up to date will result in my athlete sitting out of practice until such time as their account has been brought up to date. I also understand that sitting out of practice may result in my athlete’s role in the routine being affected.

Should an Athlete Decide to Quit
Any athlete who decides to terminate their Pegasus Cheer membership once practices have started for the season will be required to pay a cancellation fee plus all fees to date. Failure to pay will result in a third party collection agency being utilized and/or legal proceedings.

 Within 45 days = $150
 45 – 75 days = $250
 After 75 days = $500
 Within 30 days of any competition = $500 + $250 choreography fee

Unsportsmanlike Behaviour
Unsportsmanlike behaviour is detrimental to the success of Pegasus Cheer and its athletes, and can affect the gym’s ability to attend competitions now and in the future. I understand that treating any staff member or athlete, whether associated with Pegasus Cheer or any other gym or business, with disrespect (including, but not limited to, yelling, swearing, calling names, complaining to other parents or athletes) may result in dismissal from the gym. I also understand that unsportsmanlike behaviour relayed over social media in any form may also result in dismissal from the gym. Furthermore, I understand that should I, or any person in relation to me or my athlete, be heard to entice or force other athletes into leaving Pegasus Cheer, we will be asked to leave the gym, effectively and immediately terminating our membership.

Altering Pegasus Cheer Gear
No item provided to the athlete by Pegasus Cheer Athletics may be altered in any way, including the addition of names, decoration, or logo, without the express permission of Pegasus Cheer. I understand that should I choose to alter Pegasus gear in any way without permission, I will be subject to replacing said gear at my own expense. Furthermore, I understand that the use of Pegasus Cheer’s name, logo, or team names is prohibited without the express permission of Pegasus Cheer Athletics.

Alcohol and Non-Prescription Drug Usage
As an athlete, I understand that it is my responsibility to take care of my body and my health. The use and abuse of drugs and alcohol is not permitted by Pegasus Cheer athletes. I understand that if I choose to consume drugs (unless prescribed by a licensed physician) or alcohol, it may result in dismissal from the gym.

Practice Gear
I understand that it is my responsibility to ensure I wear my full practice uniform to each practice, unless otherwise instructed by my coaches. It is also my responsibility to ensure it is clean and in good repair at all times. Should my coaches feel that my uniform is not up to standard, I understand that I will need to either repair or replace it at my own expense.

Altering Pegasus Cheer Gear
No item provided by Pegasus Cheer Athletics may be altered in any way, including the addition of names, decoration, or logo, without the express permission of Pegasus Cheer.
